Consent, Waiver & Declaration of Religious Belief

Informed Consent

Our sacred sacred offering contains a natural psychoactive compound known for its profound spiritual benefits and significant effects on the body and mind. The Divine Science Society utilizes this sacred offeringfor religious purposes, not as a form of medical treatment or mental health therapy.

While the spiritual benefits can be profound, there are important contraindications to consider before partaking in the sacred offering. It should always be consumed in a safe and controlled setting. Some contraindications to be aware of include the following: Mental Health Conditions, personal or family history of psychosis, pregnant or breastfeeding, individuals on medications, high blood pressure or heart conditions should avoid taking and/or consult with a physician before taking our sacred offering. ______________________________

Release of Liability

I, by participating in the activities associated with the Divine Science Society, understand that during my participation in said activities I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in these activities. These inherent risks include, but are not limited to, the dangers of serious personal injury, sickness from ingested plants or fungi, property damage, and death (“Injuries and Damages”). I know that Injuries and Damages can occur by natural causes or activities of other persons, Church members, Church leaders, assistants or third parties, either as a result of negligence or because of other reasons. I understand that risks of such Injuries and Damages are involved in Divine Science Society activities and the use of our spiritual sacred offering, and I appreciate that I may have to exercise extra care for my own person and for others around me in the face of such hazards. In consideration for my acceptance as a participant in Divine Science Society activities, I confirm my understanding that:

  1. This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.
  2. The consumption of some plant medicines carry with it some inherent risks. Reactions to plant medicine vary, and I acknowledge that the Divine Science Society, its owners, employees, agents, and leaders, will not be held liable in the event that a negative reaction occurs. Further, I agree that the Divine Science Society, its owners, employees, agents, and leaders, are not liable for any future reactions from ingesting our sacred offerings.
  3. I am choosing to participate in the ceremonies and consume the sacred offering of my own free will.  I confirm that I can choose whether or not to participate in a free and informed manner.
  4. I am of sound mind and body to sign this release, and I am over the age of 18 years old.
  5. I have not been advised not to consume plant medicine by a medical professional.

Despite the foregoing risks and all other risks, and TO THE FULLEST EXTENT ALLOWED BY LAW, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH which might be associated with or arise out of my participation in any Divine Science Society activities. In consideration for being permitted to participate in these activities, I AGREE TO RELEASE AND DISCHARGE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE the Divine Science Society, its directors, officers, employees, agents, and leaders, and all of their successors, heirs, assigns, directors, officers, partners, investors, shareholders, members, agents, any land owners for which events take place, and employees, for injury or death resulting from my participation, regardless of the cause.  I waive my insurers’ right to make a claim against the Divine Science Society based on payments by insurers to me or on my behalf for any reason, meaning my insurers have no right of subrogation against the Divine Science Society.

I hereby agree to indemnify, defend and hold harmless the Divine Science Society from any and all claims, actions, damages, awards, or losses, including legal fees, that it may incur or sustain as a result of, or in connection to, my participation in ceremony and consumption of the sacred offering.

I understand that this is a continuing release of liability, and will apply whenever I participate in the activities associated with the Divine Science Society. I understand that this release will prevent me or my heirs from filing suit or making any claim for damages in the event of injury or death from my participation.

This release shall be governed by the laws of California and I hereby consent to the exclusive jurisdiction of such courts. 

With a full understanding of this agreement, I nevertheless enter into it freely and voluntarily and agree that it is binding upon me, my heirs, assigns, my legal representatives, and the users of any sacred offering originating from the Divine Science Society.

I AGREE to abide by all applicable local, state and federal laws, as applicable.

WITH ALL OF THE ABOVE FULLY UNDERSTOOD, I enter into this agreement freely and voluntarily.

I have read this document in its entirety and I freely and voluntarily assume all risks of such Injuries and Damages and notwithstanding such risks, I agree to participate in Divine Science Society activities.

By applying for membership with the Divine Science Society, I agree and consent to the foregoing Agreement.

Declaration of Religious Belief

This document is intended as a formal Declaration of Religious Belief. I, the undersigned, do hereby acknowledge that our sacred offerings are an essential and inseparable part of my religious practice. 

I do therefore declare that my consumption and cultivation of the sacred offering to be a strictly religious practice afforded First Amendment protection under the Constitution of the United States of America.
